Rural Funds Management Limited Privacy Policy
General
Rural Funds Management Limited ('RFM') is a specialist funds management company, formed to manage capital for private and institutional investors seeking competitive returns from large-scale corporate agriculture.
This policy describes the way that RFM collects, holds, uses and discloses personal information about you. RFM is bound by the Privacy Act 1988 (Cth) ('Privacy Act'), including the National Privacy Principles.
However, acts done or practices engaged in by RFM, which are directly related to:
- a current or former employment relationship between RFM and you; and
- an employee record held by RFM and relating to you,
are exempt from the Privacy Act, including the National Privacy Principles.
Collection
RFM may collect personal information about you in the form of your name, date of birth, address, phone/fax numbers, email address, tax file number, investment details and bank account details. This information may be collected by RFM during the course of carrying on its business through, for example, any of RFM's standard forms, such as RFM's Application Form. RFM collects this information primarily for the purpose of:
- assessing your application;
- managing your investment;
- conducting business with you;
- facilitating RFM's internal business operations, including the fulfilment of any legal requirements;
- analysing RFM's product and service offerings and customer needs with a view to developing new products;
- communicating with you about RFM's products and/or services; and
- providing you with promotional information.
In the case of tax file numbers, RFM is authorised to collect this information under Australian taxation laws. Declining to quote your tax file number is not an offence, however, if you decline to quote your tax file number, that may result in tax being deducted from your distributions at the highest marginal rate (plus the Medicare levy).
Generally, RFM will collect personal information directly from you.
Use and Disclosure
Generally, RFM only uses and/or discloses personal information about you for the purposes for which it was collected (as set out above). However, RFM may:
- use service providers in the process of collecting, using and/or disclosing personal information about you, however, these service providers are required to comply with this privacy policy in how they handle your personal information; and
- disclose personal information about you in circumstances where the assets and operations of the business are transferred to another party as a going concern.
Security
RFM takes all reasonable measures to ensure that your personal information is stored and secured safely to protect it from misuse, loss, unauthorised access, modification or disclosure.
Access
You are entitled at any time to request access to personal information held by RFM about you and to ask us to correct this information where you believe it is incorrect or out of date.
RFM may charge you a reasonable fee for providing you with copies of any information you have requested, if complying with your request requires considerable time or expense on our part. RFM may refuse to provide access to personal information held about you in any case where the National Privacy Principles allow RFM to do so.
